Registration or IP portfolios should be optimised in order to achieve maximum protection with the minimum possible investment. It is therefore advisable to carry out due diligence processes to adapt the registration reality to the needs of each situation, taking into account not only legal considerations, but also, and very importantly, the commercial and competitive strategy of each company or project. Having a higher number of registrations does not always mean better protection.
In fact, IP due diligence should extend not only to existing registrations, but also to the rights of use derived from these assets (technology transfer or licences). IP, if well managed, goes from being an expense to being considered an investment.
