What is an industrial design?
An industrial design grants its proprietor an exclusive right over the appearance of the whole or a part of a product resulting from the features of, in particular, the lines, contours, colors, shape, texture, materials, or its ornamentation. It may be two-dimensional or three-dimensional.
In practical terms: it protects how your product looks (its “skin”), not its technical function. Therefore, industrial design is especially valuable in sectors where the look & feel makes the difference: packaging, furniture, lighting, fashion, footwear, consumer electronics, cosmetics, etc.
Why is it important to protect an industrial design?
- Commercial exclusivity: it allows you to manufacture, sell, and exploit the design with a stronger position against competitors through unique and protected products.
- Defense against copies and imitations: it legally prevents the unauthorized manufacture, sale, or import of products that copy or imitate your design, preventing economic losses caused by counterfeits.
- Effective differentiation: you transform aesthetics into a barrier to entry; if you are copied, you have the legal standing to take action.
- Value as an asset: it turns your designs into tangible assets. A registered design can be licensed, assigned, franchised, or integrated into corporate transactions (investment, M&A, joint ventures), increasing your company’s value and attracting investors.
Duration
Industrial design protection lasts for 5 years from the filing date and may be renewed for successive 5-year periods up to a maximum of 25 years, upon payment of the corresponding renewal fees.
Validity
- Spanish design: validity is limited to Spain.
- International extension: within 6 months following the filing date, you may extend protection, for example, through a European Union Design (coverage in the 27 Member States) or via an International Design.
- Unregistered design: protection exists for 3 years from the date the design is first made available to the public within the EU; however, this right is weaker (limited primarily to protection against direct copying).
